Construction disputes

One of the only local firms specialising in construction disputes, Boothman Jones has the expertise and knowledge required to advise on this notoriously complex and technical area of law. Boothman Jones is well-placed to deal with all construction disputes from large scale commercial to smaller residential disputes.

Construction disputes vary enormously but our familiarity with the sector provides our clients with a forensic but practical examination of the issues (both technical and factual), along with a focused practical approach to resolution.

Trusts and Contentious Probate

With a wealth of experience in this sector, Mark and Ian are regularly instructed by trust companies, banks and beneficiaries of trusts / estates, seeking their intellect and commercial acumen in solving disputes.  With advice that means that issues are often resolved without the need of recourse to the Courtroom,  in the event that Court proves necessary, both Ian and Mark possess the expertise to take the matter to a successful conclusion and at a sensible price.

Criminal Litigation

Mark and Ian are two of a few local Advocates who are accredited to accept legal aid certificates in Jersey, as well as accepting private criminal instructions. Appearing at all levels of the criminal courts in Jersey, Ian and Mark are also regularly chosen by the Court to act as Amicus Curiae. They are both known for their expertise and experience in Court and as a result have appeared in many of the most high-profile criminal cases that have been before the Courts in recent times. This includes cases of murder, attempt murder, manslaughter, serious sexual offences, drug offences and financial crime. As a result, Ian and Mark are renowned as two of the leading criminal advocates in Jersey.

Employment Law

Mark has substantial experience acting for both employers and employees in a range of employment disputes. From advice on compromise agreements to representation in the Employment Tribunal, Mark has the skill set to deliver results whilst maintaining a close eye on commercial sensitivities which is critical in any Jersey based employment dispute. (Please note due to his ongoing tenure as a Deputy Chair in the Jersey Employment and Discrimination Tribunal, Ian is unable to currently offer advice in relation to any employment matter).

FAQs

What is a Jersey advocate and how does it compare to an English barrister?

To represent clients in the Jersey courts, you need to be a qualified Jersey advocate. Once qualified in Jersey, you will acquire "rights of audience". Unlike many English barristers, Jersey advocates often also undertake much of the background work in a case similar to an English solicitor. Please get in touch for more information.

Do all Jersey advocates regularly appear in Court?

No. There are many Jersey advocates who never appear in Court on behalf of clients. It is therefore very important that before selecting an advocate to represent you in a matter which could end up in Court, you find an advocate who has the necessary expertise. Both Mark and Ian regularly appear in Court and would be delighted to have a no-obligation discussion in relation to any prospective matter.
